MEMORIAL UNIVERSITY STRIKE AVERTED Members of the Memorial University of Newfoundland Faculty Association ratified a new contract with the university on February 15, 1996. Management had attempted to remove the union's authority in areas concerning salary, workload and job security through their original proposals. When that failed, they unilaterally tried to replace the collective agreement with a "handbook". This was successfully challenged by the union, and an agreement was reached shortly before MUNFA was to begin strike action. The contract, which extends until August 31, 1999, provides for changes in several areas. The previous contract provided for layoffs in case of program redundancy or financial exigency. In the new contract, management promises not to initiate layoffs for program redundancy until after August 31, 1999. 159 people have been declared eligible for early retirement. If 60% of these (or some smaller number satisfactory, to the administration) accept, financial exigency will not be invoked. If university management chooses to invoke financial exigency as a way of reducing the size of the faculty bargaining unit, the following process must be followed. The President of Memorial must declare a state of anticipated financial exigency. Next, a Budget Advisory Committee composed of two MUNFA representatives, two management members and a chair who is a Memorial employee elected by academic staff members will perform an iterative process of examining financial data in order to judge whether the case for expenditure reductions in salary and benefits of MUNFA members can be made. The Board of Regents will make a decision on whether a state of financial exigency exists by examining the reports of the President and the Budget Advisory Committee. Faculty reductions, if necessary, would be made first from term appointments, then from probationary appointments and finally from tenured appointments. Layoffs within each category would be made in order of reverse seniority, subject only to the provision that, as a percentage, faculty reductions within each discipline cannot exceed the university-wide percentage of faculty reductions by more than fifty per cent. While salaries are untouched (MUNFA members can expect a step raise of $1,272 every April 1), old teaching loads remain in effect unless any unit has a norm below 4 courses per academic year (2 full credits by Carleton measurement). In such cases, the new minimum norm would rise to 4. Most teaching loads in Arts and Social Sciences at Memorial are already above this level. If management decides that individual faculty members aren't doing enough research, they can be required to teach an additional course. This determination would be done on a year-to-year basis. If a program is seriously compromised by retirement or layoffs, everyone in the unit can be made to teach an extra course, determined on a year-by-year basis. In addition, teaching remission for administrative duties will be sharply curtailed, and a minimum course load of 2 courses will be imposed. The agreement at Memorial reflects local conditions, and constitutes no real precedent for negotiations at Carleton. Nevertheless, several areas where MUNFA's previous contract was modified do correspond to those in which Carleton's management is making contract demands.
